Upcoming November 6th Election includes amendment to Town’s Charter.

On Tuesday, November 6, 2018, Bay Harbor Islands electors will be able to participate in a special election, appearing within the Miami Dade County General Election ballot, which will include a ballot question regarding an amendment to the Town’s Charter.

The Charter Amendment will allow for properties located at the tips of the East Island (RM3 District) to go back to the original heights allowed prior to 2002.  In 2002, the Town passed a Charter Amendment that required that all properties in the Town have a maximum height of 75 feet, making most of the existing Tract properties (listed below), which exceeded that height, non-conforming.

The question being put forth states the following:

Bay Harbor Islands Referendum

Approval of Building and Structure Heights on Certain Tracts

Shall Article V of the Charter of the Town of Bay Harbor Islands be amended to provide for maximum Building and structure heights of 11 stories or 120 feet, whichever is less, on the six Tracts A through F on the northern and southern tips of the East Island, comparable to 1950s height limits on those Tracts, only upon approval by the Town Council after public hearing instead of by referendum?



The five properties that would be directly affected by this change would be:

Tract A - Blair House located at 9100 West Bay Harbor Drive – Built in 1970

Tract B - Mediterranean located at 9101 East Bay Harbor Drive – Built 1957

Tracts C and D - Island Point located at 10350 West Bay Harbor Drive –Built 1966

Tract E - Bay Harbor Club located at 1155 103 Street – Built 1956

Tract F - 1135 103 Street former Bay Harbor Continental. – Vacant Lot

The Town’s sample ballot for the Special Election Charter Amendment will be posted as soon as is available.  The Town’s question will appear at the end of the general election ballot.  Please make sure you vote November 6th at your designated precinct or request a Vote by Mail Ballot by Wednesday October 31.
